These terms govern your use of firsthandbitcoin.com and the Firsthand dashboard. The site is operated by NMine LLC (trading as Firsthand Bitcoin), a limited liability company formed in Wyoming. By using the site or creating an account you agree to these terms. If you buy hardware or have machines hosted with us, the Hosting Agreement also applies, and where the two conflict the Hosting Agreement controls.
firsthandbitcoin.com is operated by NMine LLC, a Wyoming limited liability company trading as Firsthand Bitcoin. "We", "us" and "our" mean NMine LLC. "You" means the person or company using the site.
Firsthand Bitcoin is a trading name. Every contract you enter into is with NMine LLC, and it is NMine LLC that owes you the obligations described here and in the Hosting Agreement.
You must give accurate information when you create an account and keep it up to date. You are responsible for everything done under your account.
Keep your password to yourself. Tell us promptly if you believe someone else has access to your account.
You must be old enough to enter a binding contract where you live, and you must not be barred from using our services under any sanctions or other law that applies to you.
We may suspend or close an account that is being used unlawfully, that is being used to abuse the service, or where we are required to do so by law. Section 6.3 of the Hosting Agreement governs suspension where machines are hosted with us.
The store shows prices, hashrates, efficiency figures, electricity costs, cost per coin, daily profit and year one return. These are estimates, produced from live market data and from what our sites actually measure. They are not a forecast, a promise or advice.
Machine prices are quoted in US dollars and change frequently, often daily. A price shown on the site is an invitation to enquire, not a binding offer. The price that binds either of us is the one on your Order Confirmation.
Where a price is shown for a future manufacturing batch, the delivery window is the manufacturer's and can move. Section 2.2 of the Hosting Agreement governs what happens if it does.
Historic price charts are drawn from supplier lists and public retail listings. Different sources are shown as separate series because they measure different things, and past prices say nothing about future ones.
Nothing on the site or in the dashboard is investment, financial, tax or legal advice, and nothing on it is a recommendation to buy anything. We are not your adviser or your fiduciary.
Mining is risky. You can lose money. The value of a machine can fall, sometimes sharply, and a machine that is profitable today may not be in a month. You are responsible for your own decisions and for taking your own advice.
You are responsible for your own tax position, including any tax on mining rewards, wherever you are resident.
Selecting machines in the store starts an enquiry. A sale is made when we issue an Order Confirmation and you pay in accordance with it.
We do not accept credit or debit cards.
The only place we publish payment instructions is the Firsthand dashboard. We will never send you new payment details by email, message or telephone, and any communication that appears to do so should be treated as fraudulent. If in doubt, sign in and check, or contact us at accounting@nmine.org. We are not liable for funds sent to details you did not verify in the dashboard.
You may read the site, use the calculator and use the data for your own purposes, including deciding whether to buy a machine. That is what it is for.
The site, the dashboard, our text, designs, data compilations and software are owned by us or licensed to us. Manufacturer names, model names and product photographs remain the property of their owners and are used to identify the equipment we sell and host.
Anything you give us — your machine details, payout addresses, correspondence — stays yours. You permit us to use it so far as is necessary to run the service for you.
We try to keep the site and the dashboard running, but we do not promise they will be uninterrupted or error free. We may change, suspend or withdraw any part of them.
The dashboard reports data collected from mining pools, from our own stratum servers and from equipment at our sites. Figures may be delayed, incomplete or occasionally wrong. Where a figure matters — an invoice, a payout — the authoritative record is the one in your account, and we will correct an error when we find one.
To the fullest extent the law allows, the site and the dashboard are provided as they are, without warranty of any kind.
We are not liable for lost profits, lost mining rewards, lost cryptocurrency, lost data, or for any indirect or consequential loss arising from your use of the site.
Where machines are hosted with us, Section 5 of the Hosting Agreement governs liability between us, including the cap on our total liability, and it prevails over this section.
Nothing here excludes liability that cannot lawfully be excluded, including for fraud, or for death or personal injury caused by negligence.
We may update these terms. The current version, and the date it took effect, is always shown at the top of this page. If a change materially affects your rights we will tell account holders by email before it takes effect.
Continuing to use the site after a change takes effect means you accept the new version. Changes to the Hosting Agreement are governed by Section 4.4 of that agreement, not by this one.
These terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles.
Any dispute will be brought exclusively in the state or federal courts of Sheridan County, Wyoming, and each of us consents to that jurisdiction.
Each of us waives the right to a jury trial and the right to take part in a class or collective action. Disputes are brought individually.
Before starting proceedings, the party with the complaint will set it out in writing and both of us will try in good faith to resolve it for thirty days. Either of us may still seek urgent injunctive relief.
